The Presidential petition by Naswa is dead on arrival. Going through the main body constituting just 24 pages, you realize that it highlights system inefficiencies and areas of improvement for future elections, but the element of rigging does not appear anywhere.
NASA hastily drafted the petition after their initial mass action and demonstration plans received condemnations from the international community and apathy from Kenyans.
The admissibility of rigging claims requires water tight material evidence that would show deliberate interference of the electoral process by the respondents, of which this is a herculean task to prove in the just concluded election. This is confirmed by the clean bill of health the process received from international observers.
Moreover, the following disturbing facts strangle any hope of a possible verdict in favor of NASA:
1. Throughout history, no presidential election has ever been nullified in the World
2. The threshold for admissibility of rigging evidence to justify going back to another gruesome electioneering process is too high for a rushed 48 hours prepared petition to reach!
3. Nullification of the Presidential process would trigger avalanche of more petitions on other seats, a scenario that's unlikely to happen!
4. The seemingly failure by the notorious civil Societies to file their own petitions on the same, unless they're waiting to be enjoined in the NASA's, speaks volume.
5. Public interest will prevail in the judgment against any ambitions of an individual.
Let our democracy blossom. Honorable exit through the courts will indeed protect the legacy of the doyen of opposition! Raila should be crowned with a PHD in Science of Opposition Politics. It will be great honor!
